These general terms of use (the “Terms”) govern the use of WeGoat. By creating an account and checking the acceptance box, you accept them. If you do not agree, do not use the service.
1. The service
WeGoat (wegoat.fr and wegoat.app) lets you create prediction groups among friends on sports competitions (including soccer and American sports: NFL, NBA, NHL and MLB), TV shows, music events or other topics, make picks, and follow results and leaderboards. It is published by OPEN, a SARL (see the legal notice).
The service is free. It is used in a web browser and can be installed on a phone’s home screen. It is also available as an app for iPhone, iPad and Mac (App Store) and for Android (Google Play); downloading an app is also subject to the terms of the store you use.
The service is offered in French (wegoat.fr), in English, in Spanish, in Italian and in Portuguese (wegoat.app). These Terms are written in French; their translations (English, Spanish, Italian, Portuguese) are provided for information and, in case of any discrepancy, the French version prevails.
2. No money involved
WeGoat is not a gambling game (jeu d’argent et de hasard) within the meaning of Article L. 320-1 of the French Internal Security Code (Code de la sécurité intérieure), nor a sports betting site. There is no wager, no financial sacrifice, no purchase of points, and no material or financial winnings. Points and leaderboards serve only for the game among friends and have no monetary value; they cannot be sold, exchanged or converted.
The app does not manage any money pool. Using WeGoat to organize wagers, bets or money pools between players is prohibited, even outside the app. The publisher may delete a group or an account that does so.
Group dare: the organizer of a private group can display a dare with no money involved, that is, a forfeit or a symbolic reward that the organizer writes (for example “The winner picks the restaurant”). The dare may not contain any amount of money: WeGoat refuses amounts entered. The dare must never be used to organize a wager, a bet or a money pool. WeGoat does not organize it, does not guarantee that it is carried out, and does not intervene between members. The dare can no longer be changed once the first question played by the group has locked. It is player content (Section 6): the WeGoat team may remove it if it does not follow these rules.
3. Minimum age
You must be at least 15 years old to create an account on your own. Under 15, registration is only possible with the consent of a holder of parental authority, given jointly with your own, in accordance with Article 45 of the French Data Protection Act (loi Informatique et Libertés). By accepting these Terms, you declare that you meet these requirements. The publisher may delete an account created without this consent, in particular at the request of a parent writing to contact@wegoat.fr.
4. Account
- You sign up with an email address (sign-in link) or, when offered, with a Google or Apple account, or a mobile number (code received by SMS or, if you choose, by WhatsApp). One account per person. Receiving the code by WhatsApp requires a WhatsApp account on that number, subject to WhatsApp’s terms.
- You are responsible for access to your email address or phone, and for what is done from your account.
- Your username is visible to the members of your groups and, for public groups, to other players. It must not impersonate another person or be insulting, discriminatory, sexual or promotional.
- You can change your username and your preferences, and delete your account at any time from My profile (see Section 10).
5. Groups, picks and results
- The creator of a group is its organizer. The organizer can appoint admins, invite or remove members, and choose the competitions. A group can be private (by invitation, or with a keyword chosen by the organizer: direct entry or on request) or public (visible in Explore, reserved for groups of the WeGoat team).
- A pick can be changed until the question’s lock time. After that, it is frozen and becomes visible to the members of the group.
- The organizer of a private group can extend, in that group only, the end of voting on a question (up to 72 hours after the official lock, for example for members who watch a replay): everyone then undertakes not to look up the result before voting, and that result stays hidden from the members of the group until the end of the extension.
- Official results are entered by the WeGoat team; soccer and American sports (NFL, NBA, NHL, MLB) game scores are imported automatically from sports data services. The results of a group’s private competition are entered by its organizer and the group’s admins. A result can be reported to the team, which checks it and corrects it if needed; points are then recalculated. The publisher does not guarantee the accuracy of every result in real time.
- Points are calculated according to the scoring scale shown in the app, which is the same for all players.
- Personal invitation link: each member of a group has their own invitation link for that group, which contains a randomly generated personal token (“?ref=”). When someone joins the group through that link, WeGoat records who invited them, for WeGoat XP (below). This information is never shown to other members. The group code typed by hand does not identify anyone.
- Printable poster: each member can download a poster of the group (PDF) with a QR code that leads to their personal invitation link. It is meant for inviting people you know. You are responsible for where you display or share it; the official visuals and logos it reproduces may not be reused for any other purpose (see the legal notice).
- WeGoat XP: in addition to group points, each member earns WeGoat XP and levels up according to the rules shown in the app (My profile): picks made, correct picks, players who became active in the groups they created or who came through their personal invitation link, groups won. Like points, XP has no monetary value (Section 2). The “Members of the month” leaderboard, in Play, shows all members the players who earned the most XP during the month (username, avatar, level, XP for the month); your level also appears next to your username in your groups’ leaderboards. You can ask to no longer appear in “Members of the month” by writing to contact@wegoat.fr. The publisher may change the XP scoring scale and remove XP obtained by circumventing the rules (for example with multiple accounts or fake players).
- Podiums and winners: the Top 3 (username, avatar, points) of the official WeGoat groups is shown to all members in Play, including those who are not in these groups. The winner of a finished group with at least two players receives a congratulations email (“Bravo”), according to their notification settings.
6. Content created by players
The names and descriptions of groups, group dares, and the competitions, questions, answers, photos and report reasons that you enter are your content. You warrant that you have the right to them. You grant the publisher, for the duration of the service and worldwide, a free, non-exclusive license to host, display and adapt them to screens, for the sole purpose of operating WeGoat. Private competitions you create for a group remain in that group after your account is deleted, without mentioning your name; they are erased with the group.
The following are prohibited, in particular:
- insulting, defamatory, hateful, discriminatory, violent, pornographic or unlawful content;
- content that targets or exposes a private individual, or that infringes privacy or image rights;
- official logos, photos and trademarks of third parties without authorization, and more generally any infringement of intellectual property rights;
- advertising, solicitation, fraudulent links and misleading content;
- any incitement to betting money or to gambling, including in a group’s dare.
Group chat: messages are visible to all members of the group. Stay respectful: the rules above also apply to messages, as does the ban on harassment and on repeated messages meant to flood the chat. The organizer and the admins of a group can delete messages in their group; any member can report a message to the WeGoat team.
Private messages: you can write to the members of the groups you share, and to the WeGoat team. The same rules apply: no insults, harassment, shocking content or advertising. Any member can block another member (who can then no longer write to them) and report a message to the team, which can delete it.
7. Reports and moderation
Any player can report a group, a chat message, a private message, a competition or a result from the app, or write to contact@wegoat.fr. The WeGoat team reviews reports and may, without notice when the seriousness of the matter justifies it, hide or remove content, remove a member from a group, or suspend or delete an account. An abusive report, or reports repeated in bad faith, are themselves a breach. You can challenge a moderation decision by writing to the same address.
8. Expected behavior
It is prohibited to disrupt the service (bots, mass account creation, circumventing the voting rules, attempting to access other players’ data, technical attacks) or to use it for commercial purposes without the publisher’s written consent.
9. Availability and liability
The publisher strives to keep the service accessible at all times, without any obligation to achieve this result: the service may be interrupted for maintenance, updates or incidents, and its features may change. As the service is free and has nothing financial at stake, the publisher cannot be held liable for a loss of points or XP, an incorrect leaderboard, an inaccurate result, unavailability, or content published by players, except where it is at fault. Nothing in these Terms excludes the publisher’s liability where the law prohibits doing so.
10. Ending use
You can delete your account at any time from My profile. Deletion is immediate and permanent: your profile, picks, points, XP and memberships are erased; your groups are handed over to another member, or deleted if they have none. The publisher may delete an account that seriously or repeatedly breaches these Terms, after informing you, except in an emergency.
11. Personal data
The processing of your data is described in the privacy policy.
12. Changes to these Terms
These Terms may change. The date of the last update appears at the top of the page. In the event of a significant change, you will be informed in the app and asked to accept the new version to keep playing.
13. Governing law and disputes
These Terms are governed by French law. If a problem arises, first write to contact@wegoat.fr to seek an amicable solution. Failing that, the dispute falls within the jurisdiction of the competent French courts; if you are a consumer, you may bring the matter before the court of your place of residence.
